H-2A Eligibility Who Can Use the Program?

The H-2A requirements apply to U.S. agricultural employers, associations and labor contractors with a temporary or seasonal need for farm or ranch labor when enough able, willing and qualified U.S. workers are not available. The program has no annual numerical cap. The employer's need must generally last no longer than one year, and a worker's total H-2A stay can be extended up to a maximum of three years.

  • Temporary or Seasonal Need

    You must show a temporary agricultural need—seasonal, peak, or otherwise time-limited—not permanent year-round staffing through H-2A alone.

  • Recruitment of U.S. Workers

    Employers must recruit U.S. workers in good faith and follow required advertising and hiring steps before relying on H-2A labor.

  • AEWR and Required Wages

    Pay at least the highest of the Adverse Effect Wage Rate (AEWR), the prevailing wage, the agreed collective bargaining wage, or the federal or state minimum wage.

  • Free Housing

    Provide free housing to workers who cannot reasonably return home each day. Housing must meet federal and state standards and pass inspection before workers move in.

  • Transportation Obligations

    Reimburse inbound travel once a worker completes 50% of the contract, provide free daily transport between housing and the worksite, and pay return travel for workers who finish the contract.

  • Recordkeeping & Compliance

    Keep accurate payroll, housing, recruitment, and employment records so you stay ready for DOL review.
